1. Introduction
Welcome to Artistic Homes ("Company," "we," "us," or "our"). These Terms and Services ("Terms") govern your use of our home warranty products and services offered through artistichomesa.com and related channels. By purchasing a home warranty plan or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. Service Agreement Terms
When you purchase a home warranty plan from Artistic Homes, you enter into a service agreement that outlines:
- The specific coverage plan(s) you have selected (e.g., appliance, HVAC, plumbing, electrical, or combination plans)
- The contract term, including start and end dates
- Premium or fee amount and payment schedule
- Service-call or trade-service fee amounts per claim
- Covered items and any exclusions or limitations
The service agreement document you receive at the time of purchase is the governing document for your coverage. These Terms apply in addition to that agreement and our general policies.
3. Coverage Limitations
Home warranty coverage is subject to the terms of your specific plan. General limitations may include but are not limited to:
- Pre-existing conditions or failures that existed prior to the effective date of coverage
- Items that have not been properly maintained or that fail due to misuse or neglect
- Cosmetic issues, code upgrades, or modifications not required for the repair of a covered failure
- Limits on repair or replacement amounts as specified in your contract
- Exclusions for certain brands, models, or types of equipment as stated in your plan
Coverage is limited to the property address listed on your agreement. You must disclose the condition of systems and appliances as required at the time of enrollment. We reserve the right to deny claims that do not meet the terms of your plan.
4. Claims Process Terms
To submit a claim:
- You must contact us by phone or through our designated channels during our business hours (Monday – Friday, 9:00 AM – 6:00 PM PST, unless otherwise stated).
- You must provide your contract number, property address, and description of the failure.
- You may be required to pay the applicable service-call or trade-service fee at the time of dispatch or as otherwise specified in your agreement.
- We will assign a qualified contractor from our network to diagnose and, if covered, repair or replace the item in accordance with your plan.
We do not guarantee a specific response time but strive to schedule service in a reasonable timeframe. Repairs are subject to parts availability and contractor scheduling. You are responsible for ensuring access to the property for the technician.
5. Payment Terms
You agree to pay all fees associated with your plan as described in your service agreement. Payment methods, due dates, and late fees (if any) will be specified in your contract. Failure to pay may result in cancellation of coverage and denial of claims. Refund policies, if any, are as stated in your agreement or in our cancellation policy provided at purchase.
6. Limitation of Liability
To the fullest extent permitted by law, Artistic Homes and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or your service agreement. Our total liability for any claim arising from or related to your plan shall not exceed the amount you paid for the plan during the twelve (12) months preceding the claim, or the maximum benefit payable under your contract for the specific claim, whichever is less. We do not guarantee that every repair will be successful or that all failures will be covered; coverage is determined solely by the terms of your agreement.
7. Governing Law
These Terms and any dispute arising out of or related to your service agreement or our services shall be governed by and construed in accordance with the laws of the State of California and the United States of America, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
8. Changes to Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after such posting constitutes acceptance of the revised Terms. For changes that affect your existing service agreement, we will provide notice as required by law or your contract.
